My Final Wish, Inc is committed to protecting the privacy interests and preferences of its donors, wish applicants, and website visitors. This Privacy Policy (this "Policy" or “Privacy Policy”) is a binding contract between you ("you", or "your") and My Final Wish, Inc ("MFW", "we", or "us"). This privacy policy (the “Privacy Policy”) explains how MFW may collect, use, and to what extent it will safeguard your personal information when you interact with MFW, whether through MFW’s website, events, donations, wish applications, or other services (the “MFW Services”). This Agreement governs your access to and use of MFW Services.

THIS POLICY TAKES EFFECT WHEN YOU ACCESS OR USE THE MFW SERVICES (the "Effective Date"). BY ACCESSING OR USING THE MFW SERVICES YOU (A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS POLICY; (B) REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, POWER, AND AUTHORITY TO ENTER INTO THIS POLICY AND, IF ENTERING INTO THIS POLICY FOR AN ORGANIZATION OR OTHER INDIVIDUAL, THAT YOU HAVE THE LEGAL AUTHORITY TO BIND THAT ORGANIZATION; OR OTHER INDIVIDUAL, AS APPLICABLE AND (C) ACCEPT THIS POLICY AND AGREE THAT YOU ARE LEGALLY BOUND BY ITS TERMS.

MFW is the sole owner of the information collected and used on this website.  We only have access to, and will only collect, information that you voluntarily give us via email, application submissions, or other direct contact from you.  We will not sell or rent this information to anyone.  Any time that you provide personal information to our website, you will be asked to provide consent to the collection of that information.

We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request(s), such as the granting of a wish, or as required by applicable law.

We collect the following types of information to provide and improve our services:

  • Personal Information: When you apply for a wish, sign up for newsletters, make donations, or participate in events, we may collect personal information such as your name, email, mailing address, phone number, and payment information.  For wish applications, we will need additional information including your medical diagnosis and any relevant special medical needs, to process your request and assess feasibility and medical safety.  If you provided a donation, we may use this personal information to provide you with a receipt or financial report.  You may also be contacted by MFW on occasion to offer you an opportunity to make another gift or inform you of events or volunteering opportunities which may arise that will directly benefit MFW.  You will always have the opportunity to opt out of future communications from us, as further detailed below.

  • Usage Data: We collect information about how you access and use our website, including IP addresses, browser types, and pages visited.

When you donate to MFW, we will ask for billing information such as your billing address and credit card number.  We use secure servers to gather and process your billing information.  Your billing information is not shared with any other organizations, and your credit card number is not retained by MFW once your transaction has been authorized and processed.

 

While we implement appropriate technical and organizational measures to protect your personal information from unauthorized access, use, alteration, or destruction, no method of electronic storage or transmission over the internet is completely secure, and we cannot guarantee the absolute security of your information.

Notwithstanding anything to the contrary in this Policy, MFW may temporarily suspend your access to any portion or all of the Services if: (i) MFW reasonably determines that (A) there is a threat or attack on any of the Services; (B) your use of the Services disrupts or poses a security risk to MFW’s website or to any other applicant or vendor of MFW; (C) you are using the Services for fraudulent or illegal activities; or (D) MFW's provision of the Services to you is prohibited by applicable law; or (ii) any vendor of MFW has suspended or terminated MFW's access to or use of any third-party services or products required to enable you to access the Services (any such suspension described in subclause (i) or (ii), a "Service Suspension"). MFW shall use commercially reasonable efforts to provide written notice of any Service Suspension to you and to provide updates regarding resumption of access to the Services following any Service Suspension. MFW shall use commercially reasonable efforts to resume providing access to the Services as soon as reasonably possible after the event giving rise to the Service Suspension is cured. MFW will have no liability for any damage, liabilities, losses (including any loss of data), or any other consequences that you may incur as a result of a Service Suspension.

9. Limited Warranty

THE SERVICES ARE PROVIDED "AS IS" AND MFW SPECIFICALLY DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. MFW SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ALL WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE. MFW MAKES NO WARRANTY OF ANY KIND THAT THE SERVICES, OR ANY PRODUCTS OR RESULTS OF THE USE THEREOF, WILL MEET YOUR OR ANY OTHER PERSON'S OR ENTITY'S REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, ACHIEVE ANY INTENDED RESULT, BE COMPATIBLE OR WORK WITH ANY OF YOUR OR ANY THIRD PARTY'S SOFTWARE, SYSTEM, OR OTHER SERVICES, OR BE SECURE, ACCURATE, COMPLETE, FREE OF HARMFUL CODE, OR ERROR-FREE, OR THAT ANY ERRORS OR DEFECTS CAN OR WILL BE CORRECTED.

MFW expressly reserves the right to change or modify the provisions of this Policy without prior notice to you. We may provide notice to you of any changes or modifications to the provisions of this Policy; provided, however, that your ongoing compliance with this Policy will not be dependent on MFW’s provision of any such notice. This Policy, and all matters arising out of or relating to this Policy, whether sounding in contract, tort, or statute, are governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice or conflict of law provision or rule whether of the State of Texas or any other jurisdiction that would cause the application of the laws of any jurisdiction other than those of the State of Texas.
